LandAirSea is lying to their customers, by claiming their products are “Manufactured in America”

There is a class action lawsuit against them because of their deceitful marketing.

The LandAirSea 54 GPS Tracker is marketed as “manufactured in the United States” at Wal-Mart, Amazon, eBay, and on other websites. All of their advertising, logos and packaging use the USA flag to deceive customers that the device is made in the USA.

Amazon is also complicit 

Amazon was notified multiple times about these violations of FTC laws, and yet did nothing to remove or change the information. Amazon is therefore silently complicit in defrauding their own customers by allowing LandAirSea to mislead them into believing the device is made in the USA. Amazon must surely know that if they remove this false information, sales will fall, so Amazon continues to propagate the misleading advertising in order to keep sales strong.

They are Disrespecting the U.S. Flag

LandAirSea uses the U.S. flag in violation of US Codes. Using the flag for advertising or anything that is designed for temporary use (such as packaging) is a violation of the following flag code and subject to imprisonment of one month.

(i)The flag should never be used for advertising purposes in any manner whatsoever. It should not be embroidered on such articles as cushions or handkerchiefs and the like, printed or otherwise impressed on paper napkins or boxes or anything that is designed for temporary use and discard.”

They are in Violation of FTC Laws

More importantly, LandAirSea is in Violation of US law regarding the usage of “Made in the USA.”

The law and its penalties:

In order for any product to be labelled or advertised as “Made in the USA” the FTC law requires that the product must be “all or virtually all made in the United States”. Any company found violating that law can incur steep penalties, including the possibility of “fines up to $43,280 per violation should they occur.”

To quote the FTC:

“Traditionally, the Commission has required that a product advertised as Made in USA be “all or virtually all” made in the U.S.” Later they clarify the statement: “ ‘All or virtually all’ means that all significant parts and processing that go into the product must be of U.S. origin. That is, the product should contain no — or negligible — foreign content.”

Here’s an example from the FTC website:

“An exercise treadmill is assembled in the U.S. The assembly represents significant work and constitutes a ‘substantial transformation.’ All of the treadmill’s major parts, including the motor, frame, and electronic display, are imported. A few of its incidental parts are manufactured in the U.S. Together, these parts account for approximately three percent of the total cost of all the parts. Because the value of the U.S.-made parts is negligible compared to the value of all the parts, a claim on the treadmill that it is ‘Made in USA of U.S. and Imported Parts’ is deceptive.”

Their Products are Not Manufactured in the United States

In LandAirSea’s situation with the 54 Tracker, they are claiming “Manufactured in the United States” with no other qualifications. However, their main chip is made by Quectel China The main chip which is the heart of the device cost is 70%-80% of the cost of the device. Quectel is located in Shanghai, China. Other chips and parts in the device originate from both China and Taiwan. The battery is made by Crazell China.
